Terms of Service

Please read these terms carefully. They contain important information about your legal rights, including an agreement to resolve disputes through binding arbitration rather than in court.

1. Acceptance of Agreement

These Terms of Service ("Terms") constitute a legally binding agreement between you and How's My Money Inc. ("we," "us," or "our"). By accessing our website, mobile application, or any services provided by us (collectively, the "Service"), you agree to be bound by these Terms and our Privacy Policy.

If you are using the Service on behalf of a household or entity, you represent that you have the authority to bind that household or entity to these Terms.

2. Not a Financial Advisor

HOW'S MY MONEY IS A TOOL FOR FINANCIAL ORGANIZATION AND ANALYSIS. WE DO NOT PROVIDE LEGAL, TAX, OR FINANCIAL ADVICE.

All insights, including those generated by our AI Assistant or "Safe-to-Spend" calculations, are for informational purposes only. You are solely responsible for your financial decisions. We recommend consulting with a certified financial planner or tax professional before making significant financial changes.

3. Accounts and Household Sharing

To use most features, you must create an account. You agree to provide accurate information and keep it updated.

Household Features

If you invite a partner or family member to a "Household" plan, you acknowledge that they will have access to any data you mark as "Shared." You are responsible for any actions taken by members you invite to your household. We are not responsible for any disputes that arise between household members regarding shared data or financial management.

4. Third-Party Data Providers

We use third-party providers, primarily Plaid Inc. ("Plaid"), to retrieve your financial data from your banks. By using the bank-sync features, you grant us and Plaid the right to access and transmit your information from the relevant financial institution.

You agree to Plaid's End User Privacy Policy. We are not responsible for the accuracy of data provided by your bank or our third-party partners.

5. Subscriptions and Fees

  • Billing: Fees are charged in advance on a monthly or annual basis. All fees are non-refundable.
  • Automatic Renewal: Your subscription will automatically renew at the end of each billing cycle unless you cancel it through your settings menu.
  • Trials: If you are on a free trial, you will be billed on the first day after your trial expires unless you cancel at least 24 hours prior.
  • Taxes: Fees are exclusive of any applicable sales or value-added taxes, which will be calculated based on your jurisdiction.

6. Your Data and Content

You own your data. We do not claim ownership of the financial information or receipts you upload.

However, you grant us a worldwide, non-exclusive, royalty-free license to use, host, store, and process your data solely for the purpose of providing the Service to you (e.g., generating your budget charts or training your personal AI assistant). We will never sell this data to third parties.

7. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, HOW'S MY MONEY INC. SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, OR CONSEQUENTIAL DAMAGES, INCLUDING LOSS OF PROFITS, DATA, OR USE, ARISING OUT OF YOUR USE OF THE SERVICE.

In no event shall our total aggregate liability exceed the total amount paid by you to us for the Service during the twelve (12) months prior to the event giving rise to the liability.

8. Governing Law & Arbitration

These Terms are governed by the laws of the State of Delaware. Any dispute arising out of these Terms will be settled by binding arbitration in San Francisco, California, rather than in court. You waive your right to participate in a class-action lawsuit or class-wide arbitration.

Mandatory Arbitration Clause
